This Site is operated by AFE Capital Connect, the trading name of AFE International LLC. References to “AFE Capital Connect,” “we,” or “us” in these terms mean AFE International LLC.

These Terms of Use (“Terms”) govern your access to and use of apply.afecapitalconnect.com, its inquiry form, and the online application available through it (together, the “Site”), operated by AFE Capital Connect (“AFE Capital Connect,” “we,” “us”). By accessing or using the Site, or by submitting the application, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

The Site is intended for use by business owners and authorized representatives of a business, for the business purpose of submitting a business inquiry or application. It is not directed to, and should not be used by, consumers seeking personal, family, or household financing, or by anyone under 18.

AFE Capital Connect is operated by AFE International LLC and provides businesses with access to an online application platform. Through the Site, businesses may submit an inquiry, request an application link, access and complete the online application, and communicate with AFE Capital Connect about their inquiry or application.

Using the Site, submitting an inquiry, or completing the application does not guarantee eligibility, approval, or any particular outcome. See Disclosures for more detail.

You agree to provide accurate, current, and complete information about yourself and your business when using the Site, and to promptly correct or update it if it changes. Inaccurate information may delay or prevent the processing of your inquiry or application.

Consent to receive text messages is optional, separate from these Terms, and not required to submit an inquiry or application. If you opt in, messages are transactional and relate only to your inquiry or application. The SMS Terms of Service govern that program, including how to opt out (reply STOP) and get help (reply HELP).

When using the Site, you agree not to:

• Submit an application on behalf of a business you are not authorized to represent, or submit false, misleading, or another person’s information;
• Use the Site for any unlawful purpose, or to submit a request for personal, family, or household purposes rather than a business purpose;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its infrastructure, or any related systems;
• Use automated means (bots, scrapers, or similar tools) to access the Site outside of normal browsing, or to submit applications in bulk or on behalf of parties who have not authorized the submission; or
• Copy, reproduce, or create derivative works from the Site’s content for any purpose other than your own inquiry or application.

The Site and its content — including text, design, graphics, and the AFE Capital Connect name and marks — are owned by or licensed to AFE Capital Connect and are protected by applicable intellectual property laws. You may view and use the Site for your own internal business purpose of submitting an inquiry or application; no other right or license is granted.

Content on the Site is provided for general informational purposes only and does not constitute financial, legal, tax, or accounting advice. Consult a qualified professional about your specific situation before making a financial decision.

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any piece of content is accurate, complete, or current for your circumstances.

To the fullest extent permitted by law, AFE Capital Connect will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of the Site or any inquiry or application submitted through it, even if advised of the possibility of such damages. Nothing in these Terms limits liability where such limitation is not permitted by applicable law.

By using the Site and submitting an inquiry or the application, you agree that we may communicate with you electronically, including by email and — only if you separately opt in — by text message, consistent with the consent choices presented to you, and that such electronic communications satisfy any legal requirement that communications be in writing.

We may modify, suspend, or discontinue any part of the Site at any time, and may update these Terms from time to time. Material changes will be reflected by updating the “last updated” date above. Continued use of the Site after a change becomes effective constitutes acceptance of the revised Terms.
